These Terms and Conditions govern access to CogAT.org and purchases from MAANHAAS LLC. By creating an account, purchasing a product, or using paid services, you agree to these Terms.
1. About CogAT.org
CogAT.org is owned and operated by MAANHAAS LLC, a United States limited liability company. These Terms apply to the website, accounts, original educational resources, practice activities, digital products, and related services (the “Services”). Our Refund Policy forms part of these Terms. Our Privacy Policy separately explains how we handle personal information.
2. Adults, Parents, and Accounts
You must be at least 18 and have reached the age of majority where you live to purchase or create a customer account. A parent, legal guardian, or other authorized adult may provide supervised access to a child. Children may not make purchases or independently create customer accounts.
You must provide accurate information, safeguard credentials, and promptly report suspected unauthorized access. Consumer accounts are for one household. Schools, tutors, learning centers, and other organizations require written permission or an appropriate organizational license.
3. Independent Educational Resource
CogAT.org provides independent educational information and original CogAT-style practice. It does not administer the official Cognitive Abilities Test. CogAT.org and MAANHAAS LLC are not affiliated with, sponsored by, or endorsed by Riverside Insights, Riverside Assessments, LLC, or the publisher of the Cognitive Abilities Test. CogAT and other third-party names and marks belong to their respective owners.
Practice questions are not secure official test questions. Practice scores are not official CogAT scores, validated intelligence assessments, or guarantees of score improvement, admission, gifted-program eligibility, or placement. Schools and test administrators control their own requirements and decisions.
4. Purchases and Access
Each Grade Practice Pass is a one-time purchase providing access for 90 days from confirmed payment, unless the product page and order confirmation expressly state otherwise. Purchases do not renew automatically. The product page and checkout show the included resources, authorized grade, current price, currency, taxes collected, and material technical requirements.
Digital access is delivered electronically to the purchasing adult’s account after payment confirmation. You are responsible for a compatible device, supported browser, and internet connection.
5. Prices and Payment
Prices may change before purchase. The price accepted at checkout controls the completed order. You authorize MAANHAAS LLC and its payment processor to charge the displayed total to the selected payment method. We may cancel and refund an order affected by a material pricing error, suspected fraud, or an inability to provide the purchased service.
6. Personal and Family License
During the stated access period, the purchaser receives a limited, non-exclusive, non-transferable, revocable license to use the purchased materials for personal educational use by the authorized child or children in one household. No ownership is transferred.
You may not resell, share outside the authorized household, publish, sublicense, scrape, bulk-download, reverse engineer, bypass access controls, use bots to extract question banks, upload secure test questions, interfere with the Services, or use CogAT.org materials to train or populate a commercial artificial-intelligence system without written permission. Lawful rights that cannot be waived remain unaffected.
7. Feedback and Reviews
You retain ownership of feedback or reviews you submit. You grant us permission to store, reproduce, and display them as reasonably necessary for their intended purpose. We will seek separate permission before publicly using a private support message, a child’s identity, or a child’s practice results for marketing. These Terms do not restrict honest reviews or lawful consumer complaints.
8. Availability, Changes, and Support
We may maintain, correct, or improve the Services, and temporary interruptions may occur. If we discontinue or materially reduce a paid service during its access period, we will provide a reasonable remedy such as equivalent access or an appropriate refund. Contact support if a purchased feature does not function as described.
9. Suspension and Termination
We may restrict access when reasonably necessary to address a material breach, fraud, unlawful conduct, abusive sharing, or a security threat. When appropriate, we will explain the restriction and allow a reasonable opportunity to resolve it. If we end paid access for our convenience rather than a breach, we will provide an appropriate refund for the affected access.
10. Disclaimers
We strive to provide accurate and useful educational resources, but content may contain errors or become outdated. To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without a promise of uninterrupted operation or a particular educational outcome. Nothing in these Terms excludes an express purchase commitment or a warranty or remedy that applicable law does not permit us to exclude.
11. Limitation of Liability
To the fullest extent permitted by law, MAANHAAS LLC is not liable for indirect, incidental, special, or consequential losses. Our aggregate liability arising from the affected Services will not exceed the greater of US $100 or the amount you paid us for those Services during the 12 months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, gross negligence, or liability that cannot legally be limited, and they do not reduce refunds owed under our Refund Policy.
12. Governing Law and Disputes
Please contact us first so we can try to resolve a concern. These Terms are governed by Ohio law and applicable United States federal law, without depriving consumers of mandatory protections that apply where they live. Subject to those protections and applicable jurisdictional rules, disputes may be brought in the state courts located in Warren County, Ohio, or the United States District Court for the Southern District of Ohio. These Terms do not require binding arbitration or waive class-action rights.
13. Changes and General Terms
We may revise these Terms for legal, technical, or business reasons. Revisions do not retroactively reduce rights associated with completed purchases. We will provide notice or obtain renewed agreement where required. If one provision is unenforceable, the remainder continues to apply to the extent permitted by law. A delay in enforcement is not a waiver.
